Documents needed
The document package for hypothec registration usually includes the security agreement, identification documents of the parties, and title documents for the secured property. The relevant land title, ownership certificate, or other proof of immovable property rights is central to the application.
If a company is involved, the file will generally need incorporation documents, authorization records, and evidence that the signatory has authority to bind the company. Where a representative signs, a power of attorney or similar authorizing document is normally required. For foreign parties, supporting documents may need translation and notarization, and execution before a Cambodian notary may be required in practice.
Supporting documents may also include any relevant loan agreement, board resolution, spouse consent if applicable, and other ancillary papers the land office expects to see. Cambodian land registration practice places significant weight on consistency across the security agreement, title documents, and identity records.
